- Stanley Forman Reed was born in Minerva, Mason County, Kentucky, on December 31, 1884. He was the only child of Dr. John A. and Frances Forman Reed. Although Dr. Reed was a practicing physician, he had many other interests, including farming and banking. These were activities which became an integral part of young Stanley's education, and in which he maintained a life-long interest.
- Reed's early schooling was received in private academies in Mason County. After graduation from Kentucky Wesleyan College in 1902, Reed went on to Yale University where he received a second bachelor's degree in 1906. At Yale he majored in economics and history, studying under well-known professors such as William Graham Sumner and Edward Bourne. His legal education began at the University of Virginia Law School in 1907.
- On May 11, 1908, Reed was married to Winifred Elgin, a graduate of Lexington's Campbell-Hagerman College. The new couple moved to New York City and Reed continued his study of law at Columbia University for a year.
- In 1909 the Reeds traveled to Europe, where a delayed honeymoon was combined with an additional years' study in civil and international law at the Sorbonne in Paris, France.
- Returning to Kentucky, Reed was admitted to the bar in 1910, and began practicing law in Maysville. He practiced alone until 1919, when he joined the firm of Worthinton, Browning and Reed. Two of that firms's principal clients were the Chesapeake and Ohio Railroad and the Burley Tobacco Grower's Cooperative Association. Reed had been active in the organization of the tobacco cooperative.
- Pursuing an early interest in Democratic politics, Reed was elected to the Kentucky House of Representatives in 1911. During his two terms in the General Assembly, he introduced child labor and workmen's compensation legislation. Reed served as chairman of the Kentucky Young Men's Democratic League for the 1912 Wilson presidential campaign. In 1918 he entered the United States Army, serving as a first lieutenant until the end of World War I.
- When the Hoover administration established the Federal Farm Board, in an attempt to deal with mounting agricultural surpluses, Reed left Kentucky to begin a long and distinguished career in Washington, D.C. Upon the recommendation of James C. Stone, who had been president of the Burley Tobacco Grower's Cooperative, and was then Vice Chairman of the Federal Farm Board, Reed, though a Democrat, was appointed General Counsel of the latter agency.
- Late in 1932, the Hoover administration elevated Reed to a more important post, General Counsel of the Reconstruction Finance Corporation. This was Hoover's chief agency designed to ease the economic depression by granting loans to banks and businesses. President Roosevelt retained Reed in that position while his administration broadened the scope and influence of the RFC.
- In an attempt to increase prices, the Roosevelt administration proposed to reduce the gold content of the dollar. Attorney General Homer Cummings asked Reed to assist in meeting the legal challenge to the government's right to cancel clauses in private contracts which required payment in gold. Arguing successfully the U.S. vs. Banker Trust Co. (Gold Clause) case before the Supreme Court, Reed won the admiration and confidence of both Cummings and Roosevelt.
- The President appointed Reed Solicitor General of the United States in March, 1935. In this post he would have responsibility for all of the government's important litigation before the Supreme Court. Reed's three years as Solicitor General spanned perhaps the most critical and difficult period in the history of that office. He diligently defended the constitutionality of the New Deal's experimental legislation before a hostile Court, against the highest-priced legal talent in the country. Give the circumstances, Reed's record was admirable. Serious setbacks occurred when the Court declared the National Industrial Recovery Act unconstitutional by a unanimous decision in the Schechter Poultry case, and again when the Agricultural Adjustment Act was invalidated in U.S. vs. Bulter. Reed countered, however, with notable victories in Ashwander vs. TVA, when the Court upheld the Tennessee Valley Authority Act, and in Alabama Power Co. vs. Ickes, where the Court's decision reaffirmed the concept of federal aid to public power projects.
- Justice George Sutherland announced his retirement from the Supreme Court in January, 1938. Roosevelt immediately nominated Reed to fill the vacancy. In contrast to that of Hugo Black, the President's first appointment, Reed's nomination generated no controversy. The soundness of his legal training, his experience as Solicitor General, and his loyalty to the administration, made Reed an obvious choice.
- For the next nineteen years Reed exercised a moderating influence on the Court while gaining a reputation as a conscientious, hard-working legal craftsman. Always civil, even in the most controversial cases, he earned the respect and confidence of his fellow Justices. Generally occupying a position somewhere between the Court's conservative and liberal wings, his influence and vote was often decisive
- Reed served under four Chief Justices--Hughes, Stone, Vinson and Warren. He wrote 339 opinions; 231 for the Court, 29 concurrences, and 88 dissents. Evident throughout those decisions is the theme of judicial restraint.
- Reed announced his retirement on January 31, 1957, and stepped down on February 25. However, he still remained active in the federal service. Allowed by law to sit on lower federal courts by designation from the Chief Justice, Reed accepted numerous assignments to hear cases in the Court of Claims and the Court of Appeals for the District of Columbia.
- Following retirement from the Supreme Court, Reed was appointed by President Eisenhower to be Chairman of the U.S. Civil Rights Commission, which had been created by the Civil Rights Act of 1957. Because he was still subject to call as federal judge, Reed soon resigned the post.
- Stanley Reed died on April 2, 1980, at the age of 95. He was the longest lived of all Supreme Court Justices. Winifred Reed lives at the Hilaire Nursing Home, Huntington, New York. Their two sons, John A. and Stanley, Jr., are attorneys in New York City.
- Scope and Content
- 400 Archival boxes including materials from Stanley Forman Reed's terms as Solicitor General of the United States, 1935-1938, and Associate Justice of the United States Supreme Court, 1938-1957, as well as materials from his early career and United States Court of Claims and Court of Appeals period, personal materials, publications, memorabilia, and photographs.
- The earliest documentation in the Reed papers records the activities of Reed's law firm and the firm's principal clients, the C & O Railroad and the Burley Tobacco Growers Cooperative Association (1926-1940). From 1929-1932, Reed served as General Counsel of the Reconstruction Finance Corporation, President Herbert Hoover's chief agency designed to ease the economic depression by granting loans to banks and businesses. President Roosevelt retained Reed in that position. While serving with the Reconstruction Finance Corporation, Reed successfully argued the Gold Clause case before the Supreme Court. The first of the eleven series of the Reed papers covers this period in Reed's career.
- In 1935 Roosevelt appointed Reed Solicitor General of the United States. He served three years in this post, defending the constitutionality of the New Deal's experimental legislation. The second series of the Reed papers includes argued and published cases from 1934-1937.
- The bulk of the Reed papers date from his tenure as a Supreme Court justice. Reed was nominated to replace retiring Justice George Sutherland in 1938. He served on the court until his retirement in 1957, serving under four chief justices: Charles Evans Hughes, Harlan Stone, Fred Vinson and Earl Warren, all of whom are represented in the Reed papers correspondence. In addition to correspondence, there are memo files, docket books, opinion files, a special master file, and published cases. Among the many cases documented in the Reed papers are Rosenberg vs. U.S., the Alger Hiss trials, and Brown vs. Board of Education of Topeka, Kansas. Also included are majority opinions written by Reed for such historical cases as Jones vs. Opelika, a case involving religious freedom, and Smith vs. Allwright, a landmark case in black voting rights.
- Following his retirement from the Supreme Court, President Dwight D. - The other series in the Reed papers include personal, miscellaneous, photograph, publication and memorabilia series, including seminar files, news clipping files, campaign material, awards, committee files, legal journals and memorabilia. Some of the material consists of correspondence by his wife, Winifred Egin Reed. In addition to the four chief justices already noted, other correspondents include: Hugo Black, Louis Brandeis, William J. Brennan, Warren Burger, Harold Burton, Thomas C. Clark, William O. Douglass, Felix Frankfurter, Dwight D. Eisenhower, Eleanor Roosevelt, Franklin D. Roosevelt and Harry S. Truman. A published inventory is available.
